Starting January 1st, 2020, Illinois residents over the age of 21 are legally allowed to possess up to 30 grams of marijuana flower or 5 grams of Marijuana concentrate for personal use, but how will this affect your workplace?
Under the Cannabis Regulation and Tax Act of Illinois, employers are legally allowed to maintain a drug-free workplace. According to the National Law Review, “The Act explicitly permits employers to adopt “reasonable” zero tolerance or drug-free workplace policies, or employment policies concerning drug testing, smoking, consumption, storage, or use of cannabis in the workplace,” so long as the policy is applied in a nondiscriminatory manner. “Employers may not discriminate against cannabis use that is off work hours. Drug Testing may be used in the workplace, but a “good faith” policy is put into place, if an employee is tested positive for cannabis used outside of the workplace, and not on company time.
